Foodborne Illness Can be Found in Food Replacements, Too

When you are on a diet or looking to bulk up, you might choose to replace or supplement your meals with nutrition shakes. You probably never think that you are exposed to hazards by consuming these shakes but the truth is, you can be. Recently, a man in Otero County and ten others reported falling ill from Garden of Life Raw Meal Organic Shake and Meal products. These cases were caused by Salmonella virchow, a strain of salmonella that can cause individuals to become ill.

Salmonella virchow and other types of bacteria can cause food poisoning, which can lead to significant damages for an affected individual. If you have suffered from food poisoning because of another party's failure to properly clean, store, transport, or prepare food, you could be entitled to monetary compensation for these damages. Work with an experienced food poisoning attorney to get started on your case.

Recall of the Shake Mix

In response to the food poisoning reports, Garden of Life LLC, the maker of the shake powders, voluntarily recalled its chocolate, vanilla, vanilla chai, and original flavored Raw Meal Organic Shake and Meal supplement mixes. Consumers who purchased these flavors from the batch stamped “Best by 09/2017” or any later date could return their items for a refund from the company. Consumers were urged not to consume products from the affected batches because of the risk of becoming infected with salmonella.

Salmonella can lead to extreme dehydration, which can in turn lead to dizziness, heat injury, swelling of the brain, and the risk of going into shock from low blood volume. Dehydration can be a result of vomiting and diarrhea and can be especially dangerous for infants and the elderly.

Seeking Compensation After a Recall

If you consumed a recalled food item or supplement and became ill after it was recalled, you need to prove that you were reasonably not aware that the recall had been issued to be able to file a claim for monetary compensation. You might have consumed the product because your local retailer chose to continue selling it after the recall or because a retailer of prepared foods, like the juice bar at your local gym, used the ingredient after being notified of the recall.

Other proof you will need to prove that you became ill and that it was because of another party's negligence includes documentation of your medical diagnosis and treatment and documentation of your expenses, such as your lost wages, that resulted from your illness.
